Terms of Use and Sale

1. Purpose and Acceptance

These Terms of Use and Sale govern access to and use of the TheDocademy platform and the purchase of services offered through it. By creating an account, placing an order, or using the platform, you acknowledge that you have read and accepted these Terms in full.

2. Platform Operator and Marketplace Role

TheDocademy operates a SaaS platform dedicated to document review and improvement. Depending on the service ordered: • AI correction is provided directly through software features made available on the platform • Human correction is organized through the platform and performed by independent professionals selected according to availability and document category • 1-to-1 sessions are organized through the platform and carried out by independent professionals TheDocademy acts as platform operator and technical/payment intermediary. Human professionals are independent contractors, not employees, agents, or legal representatives of TheDocademy.

3. Services

The platform currently offers: • AI correction — €3.99 • Human correction — €49 standard / €69 urgent • 1-to-1 professional session — €100, subject to availability Accepted file formats: PDF, DOCX, DOC, XLSX, XLS. Maximum size: 20 MB. Delivery times displayed on the platform are indicative unless an express commitment is stated at checkout.

4. Account and Eligibility

Users must provide accurate, complete, and up-to-date information. Credentials are personal and must remain confidential. You are responsible for all activity carried out from your account until proper notification of compromise or unauthorized use.

5. Ordering, Pricing and Payment

Orders are placed online. Prices are displayed in euros, inclusive of taxes where applicable. An order becomes final only after payment confirmation or, where expressly stated, after activation of a free service. Payments are processed by third-party payment providers. TheDocademy does not store full card data. TheDocademy may update pricing prospectively. Confirmed orders remain governed by the pricing accepted at checkout.

6. Performance of the Service

To perform the service, the user grants TheDocademy, and where relevant the assigned professional, a limited right to access and process the uploaded content strictly for the purposes of the ordered service, customer support, fraud prevention, and legal compliance. For human correction, TheDocademy may reassign a document to another professional when necessary to ensure continuity, quality, or delivery management.

7. User Commitments

You represent and warrant that you have the rights and permissions necessary to submit the documents and content uploaded to the platform. You must not upload content that: • is unlawful, defamatory, discriminatory, threatening, or fraudulent • infringes third-party intellectual property, privacy, or confidentiality rights • contains malware, malicious code, or technical content likely to compromise the platform • contains special-category personal data or highly sensitive data unless strictly necessary and lawfully shared TheDocademy may suspend processing, remove content, or suspend an account in case of manifest breach, security risk, fraud suspicion, or legal necessity.

8. AI-Specific Terms

AI-generated outputs are provided for assistance and drafting support only. They may contain inaccuracies, omissions, or inappropriate suggestions. The user remains solely responsible for reviewing, validating, and using the output before any personal, academic, professional, contractual, legal, or administrative use. Unless expressly stated otherwise in a separate document, uploaded documents are not reused to train foundation models on behalf of TheDocademy.

9. Human Professionals

Human correction services are carried out by independent professionals using their own expertise and judgment. TheDocademy may define platform rules, deadlines, confidentiality obligations, quality standards, and payment flows, but does not guarantee any specific academic, editorial, legal, or commercial outcome. Professionals remain solely responsible for complying with the legal, tax, social, accounting, and professional obligations applicable to their own activity.

10. Delivery, Acceptance, Cancellation and Withdrawal

Digital services begin once processing starts. For consumers, and subject to applicable law, you expressly request immediate performance of the service before expiry of the withdrawal period and acknowledge that you lose your withdrawal right once the digital service has fully begun or been fully performed, in accordance with Article L221-28 of the French Consumer Code. Before processing starts, TheDocademy may decide, on a case-by-case basis, to cancel and refund an order. After processing has started, cancellation is generally no longer possible except in the event of: • technical impossibility to perform the service • duplicate payment • manifest platform error attributable to TheDocademy • mandatory legal refund Any refund, if granted, is limited to the amount paid for the relevant order.

11. Intellectual Property and Confidentiality

Users retain all rights in the original documents they upload. You grant TheDocademy a limited, non-exclusive, non-transferable right to host, reproduce, display, and process the content strictly as necessary to operate the service. Corrections, comments, and deliverables created for a paid order are transferred to the user upon full payment, subject to third-party rights and pre-existing platform tools, templates, software, know-how, and methodologies, which remain the property of TheDocademy or their respective owners. TheDocademy and assigned professionals are bound to treat documents as confidential, subject to legal obligations, security requirements, and the involvement of technical subprocessors.

12. Liability

TheDocademy is bound by an obligation of means, not of result. TheDocademy shall not be liable for: • decisions made by the user on the basis of an AI or human correction • residual errors, interpretation choices, style preferences, or subjective dissatisfaction • indirect losses, loss of opportunity, reputational loss, data loss caused by the user's own acts, or loss of turnover • temporary unavailability, maintenance, network failure, third-party provider outage, or force majeure • the independent acts or omissions of a professional beyond the platform's reasonable control To the fullest extent permitted by law, TheDocademy's aggregate liability for a given order is capped at the amount paid for that order. Nothing in these Terms excludes liability that cannot lawfully be excluded under mandatory law.

13. Consumer Law, Mediation and Jurisdiction

If you are a consumer, mandatory consumer protection rules of your country of residence within the EU remain applicable where required by law. Complaints should first be sent to: legal@thedocademy.com. If no amicable solution is reached, consumer mediation may be used where applicable. The identity and contact details of the designated consumer mediator must be made available by the operator before publication of the service to the public. The former EU ODR platform has been discontinued since July 20, 2025. These Terms are governed by French law, without prejudice to mandatory protective rules applicable to consumers. For non-consumer disputes, the courts within the jurisdiction of the Paris Court of Appeal shall have exclusive jurisdiction.

14. Professional Sellers and DAC7

TheDocademy may qualify as a reporting platform operator within the meaning of DAC7 and applicable French tax law. Professional users undertake to provide accurate and complete identification, tax, and payment information. TheDocademy may suspend or restrict a professional account in the event of incomplete, inaccurate, or outdated compliance information. Where required by law, TheDocademy may collect, verify, retain, and transmit professional seller data to competent tax authorities. Such processing is mandatory and cannot be opted out of when legally required.

15. Suspension, Termination and Changes

TheDocademy may suspend, restrict, or terminate access to all or part of the platform in the event of contractual breach, fraud risk, payment incident, unlawful use, security incident, or legal obligation. TheDocademy may amend these Terms at any time. Material changes will apply prospectively and, where required, users will be informed by reasonable means before they take effect.
